EURASIAN PATENT EXAMINATION

The Eurasian Patent Office received 3,482 Eurasian applications in 2019, which is almost identical to the number of applications filed in 2018.

Eurasian Application Statistics

Since the year of the Eurasian Patent Organization’s establishment in 1996, through 2019 inclusive, overall 57,354 Eurasian applications were filed.

TOTAL APPLICATIONS

International applications accounted for the bulk of Eurasian applications in 2019 totalling to 2,581 applications, or 74.1 per cent of all the applications filed.

The year 2019 saw 464 applications filed directly with the Eurasian Patent Office, which accounts for 13.3 per cent of overall Eurasian application filings during the year. National IP offices of the Eurasian Patent Convention (EAPC) Contracting States channeled 437 applications in 2019, or 12.6 per cent of the total amount of Eurasian applications filed.

TOTAL APPLICATIONS

Similarly to the preceding years, the United States of America proved the largest geographical source of Eurasian applications, 913 or 26.2 per cent of all the applications filed with the Eurasian Patent Office.

Applicants from the EAPC Contracting States filed 724 applications in 2019. The largest number of Eurasian applications, which amounts to 427, came from the Russian Federation, the Republic of Belarus accounts for 111 applications, the Republic of Kazakhstan – for 107 applications and the Republic of Azerbaijan – for 53 applications.

TOTAL APPLICATIONS

The distribution pattern for Eurasian applications by industry did not change significantly in 2019. Similar to the previous years, the bulk of applications were filed for inventions in the fields of organic chemistry, pharmaceuticals and medicines. Table 1 breaks down the Eurasian applications filed in 2019 by subject matter.

The year 2019 saw 2,885 applications filed electronically, which makes 83 per cent of all the Eurasian applications filed in 2019.

Eurasian Patent Grants

In the reporting year the Eurasian Patent Register saw 2,307 new entries. The total number of EAPO grants for the period 1996 through 2019 makes 34,153 Eurasian patents.

In the year under review 2,697 Eurasian patents were granted, which exceeds the respective results of 2018 by 2.55 per cent. The grand total for 1996 through 2019 reached 34,128 Eurasian patent grants.

Applicants from EAPC Contracting States and the Republic of Moldova were granted 477 Eurasian patents in 2019, marking 17.69 per cent of all the patent grants during the year.

Applicants from States not party to the EAPC had 2,220 Eurasian patent grants in 2019. The share of patents granted to applicants from States not party to the EAPC reached 82.31 per cent of all the grants for 2019.

Representatives of 66 countries became Eurasian patent owners in 2019, including residents of 8 Contracting States to the EAPC and the Republic of Moldova.

The largest number of Eurasian patent grants in 2019 went to the applicants from the United States of America, 533 Eurasian patents (19.76 per cent); Russian Federation, 260 Eurasian patents (9.12 per cent); Germany, 246 Eurasian patents (9.12 per cent); Netherlands, 177 Eurasian patents (6.56 per cent); Switzerland, 150 Eurasian patents (5.56 per cent); the Republic of Belarus, 130 Eurasian patents (4.82 per cent); France, 118 Eurasian patents (4.38 per cent); Italy, 108 Eurasian patents (4.00 per cent); Japan, 100 Eurasian patents (3.71 per cent); Great Britain, 92 Eurasian patents (3.41 per cent); Peoples’ Republic of China, 88 Eurasian patents (3.26 per cent).

The reporting period saw 2,152 Eurasian patents, or 79.80 per cent of the total number of Eurasian patent grants in 2019, granted on the basis of international applications that had entered the regional phase of the PCT procedure.

Applicants from three EAPC Contracting States and the Republic of Moldova were granted 111 Eurasian patents in 2019, or 5.16 per cent of the total Eurasian patent grants based on international applications. The previous reporting year saw 4.64 per cent of the total Eurasian patent grants based on international applications. The largest amount of such patents, 104 (or 4.83 per cent), went to Russian Federation applicants.

At the same time, innovators from 55 States not party to the EAPC were granted 2,041 Eurasian patents or 94.84 per cent of all the Eurasian patent grants based on international applications. The largest number of patents went to the holders from the United States of America, 464 Eurasian patents (21.56 per cent); Germany, 226 Eurasian patents (10.50 per cent); Netherlands, 170 Eurasian patents (7.90 per cent); Switzerland, 142 Eurasian patents (6.60 per cent); France, 110 Eurasian patents (5.11 per cent).

As of December 31, 2019 a total of 512 Eurasian patents had been terminated in the territory of EAPC Contracting States and the Republic of Moldova due to the expiry of twenty-year term under Article 11 of the Eurasian Patent Convention.

As of the same date, the Eurasian patents in force in the territory of the EAPC Contracting States and the Republic of Moldova reached 16,686 patents.

The first annual fees for maintaining 2,199 Eurasian patents in force were paid in 2019.

Table 4 shows 3.77 as the average number of designations of the EAPC Contracting States and the Republic of Moldova at the stage of the first payment of annual maintenance fees for maintaining the Eurasian patents in force.

The recurrence of designations of the EAPC Contracting States and the Republic of Moldova in relation to the total patents for which the annual maintenance fee was paid for the first time in 2019, is as follows: Russian Federation – 96,86%, Kazakhstan – 57,39%, Belarus – 50,34%, Azerbaijan – 39,29%, Armenia – 34,06%, Turkmenistan – 33,56%, Kyrgyzstan – 31,29%, Tajikistan – 30,83%, Moldova – 3,73%.

In 2019, EAPO also received subsequent annual fees for maintaining 11,728 Eurasian patents in force.

Table 5 provides the details of Eurasian patents maintained in force via the payment of the said subsequent annual maintenance fees in 2019.

Table 5 shows 3.38 as the average number of designations of the EAPC Contracting States and the Republic of Moldova for the payment of subsequent annual fees for maintaining the Eurasian patents in force. The recurrence of designations of the EAPC Contracting States and the Republic of Moldova in relation to the total patents for which the annual maintenance fee was paid in 2019 was as follows:

Azerbaijan – 49,79% Turkmenistan – 25,90% Armenia – 23,41%
Kyrgyzstan – 43,42% Tajikistan – 25,37% Moldova – 16,90%

The year 2019 saw 129 Eurasian patents restored after lapse for non-payment in due time of the annual maintenance fee.

In conformity with national laws of those EAPC Contracting States, as well as the Republic of Moldova, which provide for additional legal protection for products requiring special permission for application, the validity of 35 Eurasian patents was extended during the period under review, at the request of the patent holders: in the territory of the Republic of Armenia (5 patents), the Republic of Belarus (6 patents), the Republic of Kazakhstan (9 patents), the Russian Federation (13 patents) and the Republic of Moldova (2 patents).

In 2019, the national IP offices of the Republic of Belarus, the Republic of Kyrgyzstan, the Republic of Kazakhstan and the Russian Federation contributed information to the Eurasian Patent Office on the registered license agreements based on Eurasian patents. Relevant information about 29 registered license agreements based on 58 Eurasian patents was published in the EAPO Gazette.
