Starting from November 1, 2022, applicants will have an opportunity to include 3D models of the claimed objects in the Eurasian patent application files. This innovation concerns both inventions and industrial designs.

The decision to start accepting three-dimensional models as part of Eurasian applications for inventions and industrial designs was unanimously taken during the 41st meeting of the Administrative Council of the Eurasian Patent Organization (EAPO) in September 2022.

This decision was adopted considering the experience of Rospatent (Russian Federation), which had previously successfully implemented such an initiative, and the readiness of the Russian Office for cooperation on technical activity needed for the respective updates of the internal information systems of the EAPO.

The innovation will greatly simplify the process of examination of submitted applications, especially in relation to industrial designs, will optimize the examination process, reveal and demonstrate in more detail the features of the object of patent application. Updated versions of Part I “Inventions” and Part II “Industrial Designs” of the Patent Regulations, the Rules and Requirements Related to the Application for the Grant of a Eurasian Patent for Invention, the Rules and Requirements Related to the Application for the Grant of a Eurasian Industrial Design Patent have already been published.

— This innovation will greatly simplify for applicants the process of filing a Eurasian application and obtaining a Eurasian patent. They will have more opportunities to demonstrate the objects disclosed in applications, and this will simplify the process of examination and preparation of a decision for EAPO examiners. In the longer run, this will reduce the time for granting patents, which means it will speed up market entry. This is especially important in relation to industrial designs, appearance of products, especially since the demand for Eurasian industrial design patents valid on the territory of seven EAPO states, has doubled over one year.
